Kerrville City Attorney Wrote in March, 2015 that Cailloux Sports Field Deal Required Competitive Bids

I attended the City Council meeting Tuesday evening when they voted to issue a $9 million certificate of obligation (bond) to build a sports complex we don't need. There has been a lot of controversy over the deal, where the city will buy a 125 acre tract south of Holdsworth Dr. from what appears to be a for profit company, Cailloux Foundation Properties, LLC, a Texas limited liability company, and have  Cailloux build athletic fields, bleachers, restrooms, etc. Total cost: $9 Million. It is impossible to tell from the contract how much is for the land, and how much for the construction. The city will not get competitive bids on the construction, or an independent appraisal on the land, as required by Local Govt. Code. It is a flagrant disregard for the law.

As reported by the Kerrville Daily Times, after I restated my concerns at Tuesday’s council meeting, Jack Pratt, mayor and imaginary Vietnam vet/Green Beret, responded, “We respect your opinion, but we’ve had four other lawyers who say the opposite.”
Mike Hayes also said Tuesday he is confident the contract of sale is legal.
“To suggest that I would put a contract in place or draft a contract because I’m on the second floor of City Hall is an insult to my ability, my training and my ethics, and I resent that,” Hayes said.

Well, that is exactly what Mr. Hayes has done. I have obtained documents from the city which include this jewel, an email he wrote to Ben Modisett at Cailloux:
"Because municipal funds are involved, my analysis so far indicates we need some form of public bidding via ch. 252, Local Govt Code...."

What is it with Kerrville? The citizens claim to be conservative, Republican, God fearing people, but they allow the community to be led and represented by a fraud who claims he was a Special Forces (Green Beret) soldier who did four or five tours in Vietnam, when he was a personnel clerk, and the closest he got to the action was an air-conditioned office in Saigon - for six weeks!

This is the kind of corruption that is commonplace in some of the border counties in South Texas. It's shocking that it happens here, with such an educated electorate.

My friends from other cities and states ask me what in the hell is wrong with Kerrville.

  1. Bringing change to Kerrville is a lost cause, as there are too many people in positions of power that benefit from the close minded, fearful culture. Hypocrisy, white collar crime will always be tolerated. Crooked hypocrites that veil themselves in the flag and Jesus will always emerge as leaders. The local intuitions act as cheerleaders for this culture, and anyone that shines light on the situation will be cast as a villain. A steady diet of Southern Religion, Fox News, talk radio and the KDT defines the difference between good and bad. Do you remember the phrase popularized Ronald Reagan, known as the 11th Commandment? If not here is a refresher:
    “Thou shalt not speak ill of any fellow Republican.”
    To criticize Conservative Christian, Republican leaders is to criticize the movement, and the true believers. It is too easy to look the other way, and to act in any other way may define you as a “Lib” or trouble maker, and will come back to haunt you in the future.

    I am amazed at how many intelligent men retire in Kerrville, and get sucked into the local culture. Some of these fine men have descended to the lowest point of their lives in terms of open mindedness, social circles, exposure to new ideas and personal integrity.

    Please consider throwing in towel and let them deceive, steal and punish to their heart’s content. They will always be miserable, and this situation cannot be changed. Get the F*** out of that sewer and resume growth.

  2. It has been a very tough six weeks for the Kerrville rednecks:

    1) The anointed Christian Conservative Mayor turns out to be a fraud.
    2) City Attorney highly questionable as well
    3) Sarah Palin fired at Fox News….PLEASE say it ain’t so…..
    4) Bristol prego from unknown babydaddy
    5) Racist Shooter kills blacks @ bible study, and the excuses by Conservatives are laughable
    6) ObamaCare wins @ SCOTUS
    7) Same Sex marriages comes to Kerr County, like it or not

    Get out the crying towels folks, because we are not done yet. In case you guys have not noticed, we have already taken every major city in Texas:

    Dallas- Progressive Democrat Mayor
    Houston - - Progressive Democrat Mayor
    San Antonio - - Progressive Democrat Mayor
    Austin - - Progressive Democrat Mayor

    But don’t worry, we won’t be taking Kerrville because there is nothing there we want, unless in the highly unlikely event we develop a penchant for junk food or want to open an Auto Title Loan business.

    The danger is that we take the AG’s office next, and then we will be coming to see you.

  3. I was disappointed by the pitiful and futile response from Gov Abbot and our County Judge to last week’s Supreme Court Rulings. While disappointed, I do understand their position. They must make a stand here, because there is nowhere to run. All of the Western Countries which enjoy the same, higher or slightly lower standard of living are more liberal and much more socialist than the US. The Texas Hill Country is as reactionary as any place in the Western World. The US, and the entire Western World is moving towards a more liberal, socialist society. For those that want to make a stand in Texas, I would like to offer a verse from a Bob Dylan song:
