The flight attendant who welcomed us aboard was a man in a dress. He was chirping 'good mornings' as we boarded and asked me how I was doing. He seemed somewhat disappointed when I just mumbled "great" with a look on my face that showed what I really thought. I was told years ago that I have an "affidavit face."

Of course Delta made him - and it was a him, even with his dress and makeup - the lead attendandant. When he made announcements it was with what I think was probably his drag queen impersonation of Scarlett O'Harra, an exagerated drawl but spoken with a deep masculine voice.

So, here I was, with a couple hundred other paying customers, confined in a little glass and alumininum tube, forced to play along with this mentally ill man's fantasy that he is a she.

The night before I had dinner at a trendy restaurant in Minneapolis. There were men in wigs makeup and sequined dresses sitting at the bar next to us.

What does this have to do with the law? Everything - the transgender movement seemingly came out of nowhere maybe five years ago. Mediocre male athletes switch to compete against girls in swimming, track, weightlifting, etc. and crush the girls who have worked and sacrificed all their lives in dedication to their sports. A mentally ill trannie murders children and teachers at a Christian church and the 'leaders' - Biden, Harris, AOC, et al - say not a word about the victims, but worry about how the murders may harm the "trans-community."

I am so glad to be back in the Texas Hill Country.
rellison@richellison.comhttp://www.blogger.com/profile/06515577298624464361noreply@blogger.com0tag:blogger.com,1999:blog-4791178038803775236.post-19543513512694249982022-12-01T07:00:00.002-06:002022-12-01T07:00:34.659-06:00Austin - Crazed Lawyer Attempts Murder of ex-girlfriend, shoots up bar - Judge release on 40k surety bond
A crazed attorney from Austin, Texas was caught on camera allegedly trying to shoot his ex-girlfriend at the bar she worked at on Saturday, police said. Read article at New York Post
<p style="box-sizing: border-box; font-family: "Times New Roman", serif; margin: 1.25rem; overflow-wrap: break-word; vertical-align: baseline;">Gavin Rush, 41, is out on bond after he allegedly stormed into the Anderson Mill Pub with a gun around 11:30 a.m. on Saturday morning and approached his ex, who was behind the bar, according to arrest records obtained by KVUE.
<p style="box-sizing: border-box; font-family: "Times New Roman", serif; margin: 1.25rem; overflow-wrap: break-word; vertical-align: baseline;">He put a small leather satchel on the table and asked if he could speak with her. <p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">A veteran New York state judge entangled in a law enforcement investigation whose property was raided by federal agents two weeks ago was found dead Tuesday morning in his home near Buffalo, his lawyer said.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">John Michalski, an acting justice on the Erie County Supreme Court, died of an apparent suicide, according to attorney Terry Connors. Michalski was 61.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Police in Amherst, where Michalski lived, declined to comment.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Connors said he last spoke with Michalski on Saturday for a meeting that lasted several hours. He appeared "to be doing well. He was strong and was participating in the meeting," Connors added.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Michalski, appointed to the bench in 2006, had returned to his duties in January after going on medical leave in the wake of an apparent suicide attempt in February 2021, Connors said.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">At the time, local news reports and video obtained by the CBS affiliate WIVB-TV found that Michalski had stepped into the path of a slow-moving tanker train. He was hospitalized with a serious leg injury.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Connors said Michalski had to satisfy conditions set by the State Court system before he could be reinstated.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">He was subject to "a battery of tests and evaluations by the Office of Court Administration," Connors said, and "performed well on all of those."

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">His apparent suicide attempt last year came on the same day that a former client and family friend, Peter Gerace Jr., was arrested by federal agents in Florida. Gerace, the owner of a strip club near Buffalo and the nephew of an alleged Buffalo mob boss, was indicted on charges related to drug and sex trafficking and bribery of a former Drug Enforcement Administration agent.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">According to an indictment obtained by NBC affiliate WGRZ, bribes were paid to the agent, Joseph Bongiovanni, "to protect (the strip club) from federal narcotics investigations."

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Indictments were filed last month by federal prosecutors against Gerace and Bongiovanni for conspiracy to defraud the United States and conspiracy to distribute controlled substances.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Both men are awaiting trial and have denied the allegations.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">While federal agents were in contact with Michalski about his friendship with Gerace, no charges had been filed against the judge, Connors said.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Michalski had also been under investigation by the state Commission on Judicial Conduct in connection with how much he was paid for performing Gerace's wedding, according to The Buffalo News.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">It's unclear why state and federal law enforcement agencies, including the FBI, New York State Police and state Attorney General's Office, executed a search warrant at Michalski's home last month. A Department of Justice spokeswoman said in an email Wednesday that the agency does not confirm or deny investigations.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">Connors said there had been a groundswell of support for Michalski upon news of his death. Colleagues and friends in their legal circles considered him a well-respected jurist, also known for his infectious laugh and love for his wife and four children, Connors said.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">He once told a mother addicted to gambling who was facing four years in prison for stealing from her son that he would instead give her probation because "you do deserve a chance for redemption," The Buffalo News reported in 2012.

<p style="color: #1a1a1a; font-family: "Helvetica Neue"; font-size: 18px; font-stretch: normal; line-height: normal; margin: 0px 0px 27px;">"He treated everyone with respect," Connors said. "He was just the type of judge who you'd be thankful for was overseeing your case."

The book that shows how many of the French were enthusiatic participants with the Nazis. Some of the victims were from affluent families that had lived in France for generations. They collected art and rare books, and some gifted their beautiful homes to the French government. It wasn't enough - the Nazis and their anti-Semite French collaborators stole everything else they had, including their lives.

France and Germany were two of the most advanced, cultured societies in the world. A nut job murdered eight people in massage parlors owned by Asians in Atlanta. The killer was white, most of the victims were Koreans. The woke mob immediately makes it a story about 'white privilege' or white supremecists, not withstanding that the killer told police that he was a sex addict who was trying to eliminate the temptation, and it had nothing to do with race.

Meanwhile, in that hellhole Milwaukee, the reporters refuse to state the race of the criminals - they were black - and calls them 'teens.' That's a weasel term for when they don't want to report that the thugs are black.

When Biden gets through stumbling through Atlanta will he fly to Milwaukee ? San Antonio Express-News reports. His firm is one of two firms representing
Bexar County in a lawsuit against manufacturers and distributors of opioid
drugs.

The woman who fled to Mexico returned to San Antonio to seek
an annulment, the warrant says. The San Antonio Express-News examined marriage
records and discovered that Phipps married his then-legal assistant Brenda Vega
on Dec. 19. She received an annulment 34 days later after filing a petition
that was amended to include Phipps as a petitioner. Vega alleged that she
entered into the marriage under duress.

Phipps’ former partner T.J. Mayes tweeted his resignation in
late January, Law360 reported
last month. Mayes resigned after filing complaints against Phipps with the Texas
Bar, the Texas attorney general’s office and the U.S. Equal Employment
Opportunity Commission, according to Law360.

In the ethics complaint, Mayes alleged improper use of
funds, “psychological abuse” of Vega, and possible “mental illness and substance
use disorder.” Mayes said he waited to report the alleged misconduct “until I
could take a series of steps to protect the physical safety of my family and my
former colleagues, including speaking to multiple law enforcement agencies.”

Another story, by the San
Antonio Business Journal, reported that a subsidiary of PNC Bank
repossessed Phipps’ private jet after he allegedly defaulted on the loan, resulting
in a legal fight over how much money the bank gets to keep from the sale.

Gabe Ortiz, an attorney at Phipps’ law firm, told Law360
that he didn’t see the kind of behavior alleged by Mayes. But Ortiz told the
publication that “high stakes litigation like that can be stressful, and it’s
not necessarily meant for everybody. And if this is your first exposure to
litigation, it can be an eye-opener.”’

In a statement to KENS5, Ortiz said the firm “denies the
unsubstantiated allegations” by Mayes.

Side with the Marxists and Anarchists

Directors and officers of the Texas State Bar have demanded that new president Larry McDougal resign. His offense - he told the truth - he said on social media that Black Lives Matter are thugs.

Now the inner clique at the Texas Criminal Defense Lawyers Association have piled on. They published an open letter demanding McDougal's ouster. When I and other members objected that the TCDLA officers did not speak for us and should not have piled on there was a backlash.

One prominent member, a tenured law professor at Texas Tech wrote - 'White people - STFU.'
I responded - why isn't that just as racist as saying 'black people STFYU."

To which the list server moderator, Jeep Darnell wrote to me: "you took it too far. Do not ever post something about 'blacks' again or you will be removed.'

So, I asked: I want to make sure I understand -
it's okay for a member to tell 'white people' to STFU
but I can't even use the word black
Can I say Black Lives Matter?
Can I say that I agree that blacks have been discriminated against?
Can I say that your policies discriminate against whites and other races?
I just want to be sure I fully understand the rules here.

Mr. Darnell told me, don't be silly.

I briefly considered sending the law professor's comment white people STFU to the dean of the law school - I have seen tenured professors get fired for less than that if they comment was about a minority.

These fools need to understand something. We can play this game too. How many lawyers can say that in the last ten years they never made a racist, sexist, or homophobic joke on social media? The gotcha game can work both ways.

If you love this country and don't want it destroyed you have to fight back!!

I haven’t posted anything on this blog in a long time. Partly I think, because I fell into the rabbit hole of wasting time on Facebook. I closed my account about 10 days ago. FB makes it hard to quit - you’re not really out until you go 30 days without logging in. Anyway, when the Corona virus and shutdown started, followed by the Antifa and BLM riots, I began pissing away probably two hours a day on FB. The fools, or useful idiots as Lenin called them, angered me with their smugness and condescension. I know lawyers who live in million dollar homes and on multi-million dollar ranches in the Hill Country who think what the anarchists are doing - tearing down monuments of Washington, Jefferson, and even Grant and black soldiers who fought for the Union, is a wonderful thing. I wonder how they’ll feel when the mob shows up at their gate. Oh yeah - we already saw that with the two plaintiff’s lawyers in St. Louis who pointed guns at the BLM protestors.

The ignorance of so many supposedly educated people is astounding. It’s as if they’ve never read anything about the Bolsheviks in Russia, or Maoists in China and so many other benighted countries. Or what happened in South Africa and Rhodesian, which were both first world countries.

Which brings me to the main point - the current president of the State Bar of Texas, Larry P. McDougal, is being savaged by the other officers and directors because he told them truth when he called Black Lives Matter a bunch of thugs. They say he is a racist and some are demanding that he resign immediately. They ignore the truth - BLM was started by self described Marxists. They do not was racial equality, they want blacks superior and privileged over whites. They and their friends in Antifa have burned and looted cities all across this country. They want to erase American history. They want whites to get down on their knees and beg forgiveness for their ‘white privilege.’ They have murdered cops, both black and white, and business owners trying to protect their property

I know my comments are not politically correct and that most people will say who cares what Ellison thinks. So be it - but I believe most Americans are afraid to tell the truth because they don’t want to be the next victims of the mob.

A federal judge in Houston has ruled that there is no need to sanction a former BigLaw lawyer after a motion accusing him of “shaking his behind” at a mediation went viral.

U.S. District Judge Lee Rosenthal noted that the facts are in dispute about what happened and who is to blame.

Duffy was a partner at BakerHostetler when the sanctions motion was filed in February. Rosenthal began her opinion this way: “One of the sentences a judge does not imagine—much less welcome—writing includes the words ‘butt shaking’ in describing a lawyer’s alleged actions at a mediation. Sadly, those words fit here.

It is important for the American justice system that we prosecute those who represent that the justice system is for sale. The Colombians, and criminals in every other country that we deal with, need to understand things don’t work that way in the United States. BLOG NAME CHANGE?

I've tried changing this blog's name because the current one, Judges and Lawyers Hall of Shame, might be misinterpreted to mean that I don't respect the judiciary or think that all lawyers are somehow corrupt. On the contrary, I think the legal profession is like any other - most of its members are honest, hardworking and try to do the right thing. There a few bad apples that are the exception. I've tried changing this blog's name but it dropped off the map. It's been online for over 10 years and Google and other search engines recognize it so I guess I'm stuck with it.

At Thanksgiving I was thinking about things I'm thankful for and one of them was that it is a pleasure to be a lawyer in Kerrville and work with Judges Williams, Emerson and Harris, the prosecutors Lucy Wilke and Scott Monroe and Heather Stebbins and their staffs. Our defense bar sticks together and I can always ask someone for help and advice. So, thank you to the Kerr County legal community.

A South Texas jury on Thursday found 13th Court of Appeals Justice Rudy Delgado guilty of eight federal charges related to judicial bribery allegations.

The jury in the U.S. District Court for the Southern District of Texas found Delgado guilty of conspiracy to commit bribery concerning programs receiving federal funds, obstruction of justice, three counts of federal program bribery and three counts of Travel Act violations.

Delgado’s attorney, Michael McCrum, owner of McCrum Law Office in San Antonio, confirmed the guilty verdict. He said Delgado plans to appeal, and declined to comment further. Angela Dodge, a spokeswoman of the U.S. Attorney’s Office for the Southern District of Texas, also confirmed the verdict.

“The bribery of a judge may be the worst break of the public’s trust in government,” said U.S. Attorney Ryan Patrick of the Southern District of Texas, in a statement. “Rudy Delgado used his position to enrich himself. He didn’t just tip the scales of justice, he knocked it over with a wad of cash and didn’t look back. Delgado’s actions unfairly tarnish all his former colleagues.”

<span style="font-family: "Palatino Linotype", serif; font-size: 13.5pt;">Last week a Kerrville police
officer fatally shot a 17 year old man named Tommy Hranicky who refused to drop
a knife. Details are sketchy but based on the news reports I think it was a
justifiable shooting. If the decedent’s survivors are thinking about filing a
law suit they will have an uphill battle. Just looking at a picture in the Kerrville Daily Times, Tommy looks like a nut.

<span style="font-family: "Palatino Linotype", serif; font-size: 13.5pt;">According to police,
Hranicky approached the officer while threatening him with the knife. After
backing up and issuing multiple commands to stop and drop the knife, the
officer fired his sidearm, authorities said.

<span style="font-family: "Palatino Linotype", serif; font-size: 13.5pt;">In a somewhat similar case, Andrew Kisala v. Amy Hughes, 584 U.S.
___ (2018) the Supreme Court held that an officer was justified in shooting a
woman who refused to drop a knife. She was on the other side of a fence and not
approaching the officers.

<span style="color: #111111; font-family: "Palatino Linotype",serif; font-size: 14.5pt;">Citing precedent, the
court said that the question of whether an officer used excessive force hinges on
the specifics of each case, including whether the suspect posed an immediate
threat, and that the reasonableness of a use of force must be judged from
the officer’s perspective. Officers were entitled to qualified immunity as
long as no similar precedent existed showing a specific use of force was
unlawful.

<span style="font-family: "Palatino Linotype", serif; font-size: 13.5pt;">In Graham v. Connor, 490 U.
S. 386, 396 (1989), the Court held that the question whether an officer has
used excessive force “requires careful attention to the facts and circumstances
of each particular case, including the severity of the crime at issue, whether
the suspect poses an immediate threat to the safety of the officers or others,
and whether he is actively resisting arrest or attempting to evade arrest by
flight.” “The ‘reasonableness’ of a particular use of force must be judged
from the perspective of a reasonable officer on the scene, rather than with 20/20
vision of hindsight.” Ibid. And “[t]he calculus of reasonableness must
embody allowance for the fact that police officers are often forced to make
split-second judgments—in circumstances that are tense, uncertain, and rapidly
evolving—about the amount of force that is necessary in a particular
situation.” Id., at 396–397.
