Sheriff's deputies say Mosley walked into Discount Gun Sales on Southwest Beaverton-Hillsdale Highway around 4 p.m. Thursday with a bat in hand and smashed a display case.

But they say when Mosley tried to steal a gun, the store manager simply pulled out his own personal firearm and pointed it straight at the would-be-robber. The manager then yelled some orders at the guy and got him to drop the baseball bat, the gun he had tried to take and a nine-inch long knife he had on him.

When sheriff's deputies arrived, they found Mosley on the floor being held at gunpoint by the manager. They handcuffed Mosley on the spot and took him into custody on charges of first-degree robbery, first-degree theft, unlawful possession of a firearm and second-degree criminal mischief. Bail was set at $250,000.

State District Judge Carlos Cortez arrested on assault charge at his Dallas apartment



The charge against Cortez, a civil court judge, is a third degree felony, which is punishable by up to 10 years in prison.
Cortez, a Democrat, was first elected in 2006. He is up for re-election next year.
He filed a defamation suit against Dallas lawyer Randy Johnston in 2010 and has since spent more than $100,000 of campaign funds trying to keep some details of the suit sealed. The Dallas Morning News has previously reported that some of the documents seem to pertain to the use of drugs and prostitutes. Cortez denies them, the News reported.

“There's no sheriff, there's no chief, no law enforcement CEO in the United States or the state of Texas who would tolerate or ignore something like this,” said Treviño, whose department has been scandalized by a wide-ranging federal investigation of corrupt law enforcement officers on the Texas border who took bribes from drug traffickers.

I hope the prosecutors crucify this thug. I do question why, when a white punk assaults a black man, the feds jump on it, but have nothing to say about the many documented cases where it’s black thugs attacking white victims.

On this case, why don’t the feds let the State handle it? Under Penal Code 22.04, he can be charged with aggravated injury to an elderly person, a 1st degree felony (5-99 yrs or life).

I know it offends some of the more liberal people who read this blog, but - if I had seen this criminal attack a 79 year old man, I would have done whatever it took to stop it, up to and including using deadly force, which, depending on the threat level, could well be justified. I don't care what race they were - wrong is wrong.

Pastor John Hagee told members of his flock Sunday at Cornerstone Church that “Christmas is under attack in America” because workers who run government offices now greet people with “Happy Holidays” instead of “Merry Christmas.”
He said that any non-Christians and atheists who didn't believe in Jesus Christ should just leave the country, as the United States was built upon a Christian foundation.
------- I wonder - does this apply to Jesus, Joseph and Mary and all the other Jews?? And who cares what postal clerks say? And for that matter, under Hagee’s regime, Thomas Jefferson and most of the other Founders would have been deported - they were more Deists than Christians, and they certainly weren’t deluded money grubbing hucksters like Hagee.

“America was built by Christian people who believed in the word of God. ... If our belief in God offends you, move,” Hagee said before informing atheists that "we don’t want you and we won’t miss you, I promise you.”

Hagee probably would include Jews in the people he would deport. He has declared on multiple occasions that God sent Adolf Hitler as a "hunter" to kill Jewish people for “disobedience and rebellion.”

I plead guilty to being one of the thousands of foolish white liberals who ignored all the facts about Obama in 2008 - the Jeremiah Wright hatred of white America, the close friendship with terrorist Bill Ayers, his sheer un-American background and character, his probable homosexuality, and his utter lack of any experience to qualify him for the presidency - and voted for him to expiate for a sense of being born white. I knew I'd made a big mistake when he sent the bust of Winston Churchill back to England. It just got worse and worse, starting with the World Apology Tour where he bowed and scraped to Muslim dictators and other thugs. Sarah Palin was far better qualified to be commander in chief, and she is a patriot.
Obama has set race relations in this country back by at least 40 years. Whatever guilt I felt about being a white Southerner is long gone, and I doubt that I'm alone. I haven't seen this nation this polarized since the 60's and 70's, during the civil rights movement and the Vietnam war. I am very concerned at the turn this country has taken. A creep on MSNBC can say he'd like to urinate and defecate in Sarah Palin's mouth and the lefties have nothing to say about violence against women. But the dude with the ZZ Top beard on Duck Dynasty (which I have never watched) makes a few comments about his views on homosexuals and it's time to light up the bonfire to burn him at the stake.
The left wanted to crucify George Zimmerman, but has nothing to say about the violent crimes committed by black thugs. Here are a few examples:

The New York Daily News reports that four black suspects were arrested for shooting a young lawyer in the head in front of his wife so they could steal their Range Rover. The couple had just finished their Christmas shopping. One of the killers was named Karif, another Harif, presumably brothers. I'm waiting for the president and Al Sharpton and Jesse Jackson to condemn the murder like they did when Trayvon Martin got shot.
New Jersey is one of the states that won't issue CHL licenses to law abiding citizens and restricts the capacity of magazines. I guess it didn't stop Harif and Karif from getting guns.

Here's a story about another bunch of lowlifes who steal cars or purses from women at day cares, cash victims' checks, and steal identities.
They operate all over the country.

Meanwhile, some genius trying to sell the disaster called Obamacare came up with an ad that shows what Obama and the other radical leftists who have taken over the Democratic Party think appeals to young Americans - Pajama Boy. Did Carlos Marcello Order the Hit on JFK?
I'm reading a fascinating book by Lamar Waldron, The Hidden History of the JFK Assassination, that makes a compelling case that Carlos Marcello was responsible for the murder. In 1969 my father was transferred from Natchez, MS to Gretna, LA to work as a manager for Schulmberger Offshore. He learned that one of the dispatchers, a big-bellied, barrel chested coonass - we'll call him Boudreax - was running a bookmaking operation from the company offices. When my dad told him to stop, Boudreax said, "I can have a yo-yo like you knocked off for $500. Ask around about me." My dad did, and learned that Boudreax was a high level bookie for Marcello. My dad went back and asked if they could just forget about it and start over. Boudreax grinned and said sure they could. He added that if my dad ever had a problem with the parish to let him know.
A couple of months later I ran a red light and hit a car with three black people in it. No one was seriously injured but they were ready to milk it for all the insurance money they could get. One of the woman was moaning and groaning about her recent gall bladder surgery. A parish deputy showed up, and I very stupidly admitted that I ran the red light. He was writing the ticket when my dad showed up and asked to speak privately with him. My dad told him that he worked with Boudreax, and the deputy said, "Tell your boy next time don't admit he ran the light," then he tore up the ticket.
I got another insight into Marcello's power when I foolishly mouthed off that instead of killing foreign leaders like the Diems, the CIA should go after Marcello. This was a year or so before I got my ticket fixed courtesy of the Mafia. Anyway, I was riding home from college in a car driven by a red headed Irish kid. We were in the middle of the swamp between Hammond and New Orleans. He pulled over and started yelling, "Carlos Marcello is my uncle, you son of a bitch. I drive a cat for him every summer." He was really wound up, and I apologized and said I obviously didn't know what I was talking about, that his Uncle must be a truly wonderful man, and so on. I didn't want to get the shit beaten out of me and thrown in the swamp. He accepted my apology and gave me a ride on into town. The point is, Marcello ran Louisiana like a feudal kingdom. Nothing moved or got done without him getting his share.
The Kennedy brothers went after Marcello with a vengeance. When they couldn't get him legally, they basically had him kidnapped by INS, flow to Guatemala, and dumped in the middle of a jungle. Marcello, who was well into his 50's, was in his suit and Gucci loafers, stumbling around, falling down ravines, bitten by insects.
Meanwhile, the Kennedys were using the Mafia to try to kill Castro. It all blew up on them. I don't know if Marcello was behind the JFK assassination or not. I do know that the Kennedy boys didn't play by the rules, and believe somene they crossed or tried to whack - Marcello, the CIA, Castro, who knows? - decided they didn't have to play by the rules either.

Kerrville's Dumbest Criminal; DHS Helping Drug Cartels

Tattooing minors, then violating probation, then cussing the judge nets 60 year prison term

The San Antonio Express reports on one Raymond Nathaniel Hale, who was on deferred adjudication probation for tattooing two young girls. The actual charge was injury to a minor. Raymond is a frequent flier in the criminal justice system. The Kerr County District Clerk shows at least 20 prior arrests for various crimes - theft, bail jumping, injury to a child or elderly individual, sexual assault of a child, failing to register as a sex offender, and burglary. One thing that I don't understand - why is someone like this not already in prison for about 50 years? If our prosecutors and judges would slam the serious criminals we could cut the crime rate drastically. I bet that 80% of the crimes are committed by 20% of the people who get arrested. One reason so many people (and I'm one of them) move from Houston to Kerrville is to get away from the street crime.

Anyway, Raymond pled guilty a year or so ago to tattooing two young girls on the belly - below the panty line. He was given another chance and placed on deferred adjudication probation. Of course he violated, and yesterday went before Judge Keith Williams. When the judge sentenced him to 50 years, Raymond, who is black, went off on a rant about how the judge was racist. He threw in a few F-words too. Here's a hint for anyone in front of a judge who has your fate in his hands - don't yell and curse at the judge. Raymond's tirade got him an extra 10 years in the Big House.

A United States federal judge has accused President Barack Obama’s Department of Homeland Security (DHS) of being complicit in helping Mexican drug cartels and felons inside America smuggle illegal aliens into the country.

In a court order he signed on Dec. 13, 2013, U.S. District Judge Andrew S. Hanen of the U.S. District Court of the Southern District of Texas wrote that four times in the last four weeks he has heard troubling cases involving the DHS’s complicity in helping smuggle people across the border to their final destination.

CHL Holder Ronnie Bock Makes Citizen's Arrest of Thug at Middle School; Thug and His Brother Get Slap on Wrist After Accosting Woman and Assaulting Police



The headline: "Man Pleads Guilty to Biting Officer After Twins Tussle With Police."
This is almost a Keystone Kops story, except people could have been seriously injured.
The Kerrville Daily Times reported on Dec. 3 about two brothers from Ector County, Sean and Shane Muirhead, who, after accosting a woman at the local IHOP, fought with police and tried to bite one of them. The brothers accused the woman of following them and tapping their phones for the FBI. Obviously they were high on some drug. They followed her to her car, screaming at her, then beating on the car trying to get in.

The cops were not in control of the situation, since the first one on scene, Zachary Martin, put them in the back of his patrol car unhandcuffed. When they started trashing the car, the cops tried to pull them out and cuff them. The cops pepper sprayed them (and one of themselves), and the cops ended up rolling around on the ground with one of them, who was trying to bite them. One was injured by the handcuffs flailing around. The other ran across the street and was only prevented from entering Hal Peterson Middle School by a civilian, Ronnie Bock, who made a citizen's arrest. Ronnie is a licensed CHL carrier, and he ran across the road through traffic and pulled his pistol and ordered the thug to the ground. The thug was frothing at the mouth "like a St. Bernard," but he complied.

Attacking and injuring a cop, trying to bite him, and striking him with handcuffs - sounds like aggravated assault to me, which carries a penalty range of 2-20 years. Let's see what the brothers were charged with. Shane Muirhead was indicted for assault on a public servant, a third degree felony, punishment range 2-10 years. Get this - he was allowed to plead guilty and got probation! If the paper is accurate, it's ever better - deferred adjudication, meaning that if he completes his probation the case is dismissed so he will have no conviction on his record.

His brother Sean got an even better deal - he was charged with misdemeanor offenses of resisting arrest, and get this - got time served of 65 days.

What I don't understand is - why didn't the cops push to have these thugs indicted for serious felonies? Why didn't one of the local district attorneys take this to the grand jury? Why did the judges approve these handslap pleas? This whole thing makes absolutely no sense.

Kerrville is a town where a first time, non-violent drug offender can get sent to the pen for years. Meanwhile, we have the case of one Nicole Lee England, who was arrested for the 23rd time in Kerrville this week. Her record includes criminal trespassing, theft by check, shoplifting, resisting arrest. Here's the best one - cruelty to animals for stabbing and strangling a dog. What in the hell is this woman doing loose? Why doesn't one of our three prosecutors charge her as an habitual criminal and send her away for about 25 years?

Getting back to the Muirhead brothers, the only actor in the whole drama who showed any common sense was Ronnie Bock, a civilian, and a real hero. And if you think the cops are going to show up and save you, good luck with that.

How to Solve the "Knock Out" Game Problem



I have a solution for the "knockout" game that is spreading across the country, where young black thugs sucker punch white people. It's called the 1911 .45 with hollow points. Or a street sweeper shotgun.

A new deadly “game” called “Knockout” is crossing the nation, especially among black teenagers, in which they try to punch a randomly-selected person walking by on the street so hard with one blow that knocks them unconscious—but the results have sometime proven fatal.

In the New York area in particular, there also seems to be an anti-Semitic motivation to some of the attacks. One black teen, asked why the players savagely attack their victims, simply said, “For the fun of it.” Another added, “They just want to see if you got enough strength to knock somebody out.”

El Paso, Texas—An Assistant District Attorney for El Paso County has been charged for allegedly taking bribes to dismiss criminal charges.
The defendant, former Assistant District Attorney Antonio Reyes, was employed by El Paso County, Texas. The indictment reveals that Reyes allegedly conspired with individuals, known and unknown, to engage in wire fraud and accepting of bribes in the form of cash to dismiss criminal charges.

That was four days after he was booked for criminal contempt of court in the wrongful conviction of Michael Morton for the fatal 1986 beating of Morton's wife.

I like visiting New York City but there's no way in hell I'd live there. I thought the crime rates had been pushed down and it was much safer there now, but the recent stories coming out of there - the black motorcycle gang beating the Asian American couple, the black thugs playing 'knock out the jew,' and now this latest story, about a pack of skateboarders beating a store owner:

NEW YORK (CBSNewYork) — A pack of skateboarders savagely attacked a Lower East Side store owner when he confronted them about shoplifting, police said.

As CBS 2′s Tracee Carrasco reported, surveillance video shows the four suspects with skateboards bombarding the Eastern Supermarket last Friday.

They were allegedly stealing sodas out of a cooler. After Zhen Dan Guo followed them outside to demand they pay, a scuffle broke out. The suspects then used their skateboards as weapons.

Guo’s son, Linbin, shared photos with Carrasco of his father’s injuries after he was badly beaten, but the images were too graphic to be shown.

“The bone, it cracked in his nose,” Lin Bin said as he described one of the injuries seen in the pictures.

Doctors said Guo will need four titanium plates inserted in his face.

TUCSON, Ariz. (AP) — Two suspended U.S. Border Patrol agents were sentenced to two years in prison each for violating the rights of four suspected marijuana smugglers in southern Arizona by taking some of their clothing and force-feeding them pot.

In April, a federal jury in Tucson convicted agents Dario Castillo, 25, and Ramon Zuniga, 31, of violating the four suspected smuggler's civil rights.

U.S. District Judge Jennifer Zipps sentenced Castillo and Zuniga on Tuesday.

Ex-prosecutor jailed in wrongful conviction case

Today in Texas, former prosecutor and judge Ken Anderson pled guilty to intentionally failing to disclose evidence in a case that sent an innocent man, Michael Morton, to prison for the murder of his wife. When trying the case as a prosecutor, Anderson possessed evidence that may have cleared Morton, including statements from the crime's only eyewitness that Morton wasn't the culprit. Anderson sat on this evidence, and then watched Morton get convicted. While Morton remained in prison for the next 25 years, Anderson's career flourished, and he eventually became a judge.

In today's deal, Anderson pled to criminal contempt, and will have to give up his law license, perform 500 hours of community service, and spend 10 days in jail. Anderson had already resigned in September from his position on the Texas bench.

I agree with the author of Grits for Breakfast' article Ken Anderson's punishment for Brady violations tepid justice: "A prosecutor going to jail for Brady violations may be a first, but compared to what Morton faced, it's hard to say with a straight face that Anderson was "actually punished in a meaningful way." Losing his bar license is surely a bigger deal than ten days in jail. And at his age, with his judicial pension intact, losing his license wasn't as harsh a punishment as the national media disapprobation he's endured. As justice goes, this outcome represents relatively weak tea compared to the monstrous injustice Michael Morton endured at Anderson's hands."

This past Monday in Burbank at just before 1 p.m., five individuals entered a Sports Authority and soon after they were off. Video shows them running out the door with rack after rack of apparel and an employee giving chase.

Come to Kerrville to See Real Live Angels and Orbs!!


Sometimes I wonder what a visitor to Kerrville would make of the mentality here. They would see the Coming King Sculpture Prayer Gardens, which is really a rather large scarred section of land on a hill overlooking a used car dealership, crowned with with a 77'7" rusty looking metal cross, and a few statutes that some wits have compared to the kind of kitsch you'd see at a water park. There's one of Jesus, pretty much naked except for a robe that flows over the rump of his stallion, and a crown on his head. He's holding a sword, and the reins of the horse appear to be curved seashells, or maybe the magazines for an AK-47, or as the Mexicans call them, "cuernos de chivo," or horns of the goat. It brings to mind a bumper sticker I saw a few years ago, "Jesus is coming, and boy is he pissed." There's another of the Savior washing the filthy feet of some disciple or other, and another of a huge pair of nails, presumably like the ones the Romans nailed him to the cross with.

The Coming King Foundation's website "shares documented, supernatural miracles that are occurring daily at The Coming King Sculpture Prayer Garden in Kerrville, Texas."Great balls of fire,there's even pictures of angels!! Max Greiner, Jr., who designed the prayer garden, said something else is accumulating beneath the sculpture: a golden-dust that falls on the prayerful. Greiner said the shiny material is mentioned in the Bible.

“It can look like glitter make-up or glitter. But when you didn’t put on glitter make-up, and it suddenly starts covering your hands and faces and clothes, then you know it is God,” said Greiner.

In another photo, there is an image of a blurry figure many believe is an angel appearing at the foot of the cross. Hicks said there was no one near the cross on the April evening when he took the photo.

For a while the genius behind this project, Max Greiner, recounted how he would go to the foot of the cross, and if he didn't see any angels he would ask God to send some or show some or however it works, and God would oblige him. Now, silly me, I would think God would have better things to do, like cure a child or two or cancer, or stop a woman from being raped, but, the Lord works in mysterious ways.

The website also reports that "the visible glory of God has appeared out of thin air on literally thousands of people who have visited the "The Coming King® Sculpture Prayer Garden" in Kerrville. The sparkling substance, which looks like fine glitter, has been examined by Texas A&M University. They determined it is not gold or any know element in the universe. It is a new substance which appears on the hands, faces, clothing and Bibles of those seeking God." With all due respect to the Aggies, you'd think that Harvard or MIT might send a scientist or two down here to get a gander at this "new substance," previously unknown to science. My lord, what if it was the long sought after fountain or youth, or the source of perpetual, renewable nonpolluting energy, or a cure for cancer??

Our hypothetical visitor might read our excellent local newspaper, the Kerrville Daily Times, which in the regular Friday faith section features a biblical scholar named Chris McKnight, of the Kerrville Bible Church. Today's feature is titled "Salvation as an Act of Creation, Part III," which begins "Born again means exactly what it says. Only then can old things pass away because the old man has passed away!. Strike the root, kill the fruit." (I don't think this alludes to people of the gay persuasion).

Anyway, our visitor will have his spirit refreshed when he heads north to the Glen Rose Creation Evidence Museum, where he can see actual fossils, verified by Texas A&M scientists, of footprints left by Adam and Even walking with dinosaurs!!

Meanwhile, some of the idiots who have power in this state want our children's textbooks to teach creationism. I think the text books are written by Aggies.

The alleged shooter’s father-in-law compounded the trouble when he allegedly threw the suspect’s rifle in a pond in an attempt to hide evidence. The father-in-law was a felon and wasn’t supposed to have a firearm, so the 53-year-old was charged with “felon in possession of a firearm and destruction of evidence.”

First Assistant District Attorney Michael Jarrett said he asked fellow prosecutor Landon Ramsay if he could see Ramsay’s new Glock .40-caliber pistol about 2 p.m. Monday.

Jarrett said he asked Ramsay if the gun was loaded and was told it was not. Jarrett pulled back the slide, he said, to double-check if it was loaded and didn’t see a bullet slide into the chamber.

On the Continuing Decline of the United States of America

I'm embarrassed to admit that I voted for Obama in 2008. I ask myself now how I could be so foolish. I've concluded that it was some misguided effort to atone for my supposed sin of being born and reared in the South in the 50's and 60's, to prove that I was really a racist. I bet there are a lot of other white voters who did the same thing.

At the time I discounted his utter lack of any experience besides being a "community organizer," or in more direct language, a poverty pimp. I discounted the long, close association with the Weatherman terrorist Bill Ayers, and the hateful, racist Jerimiah Wright. I laughed at the jokes about Sarah Palin, but guess what - she had more executive experience that Obama, and as dingy as she sometimes sounded, at least she was a patriot who loved America.

I thought the people who said that Obama was a radical leftist/Moslem/alien were nutty. I now believe they were right all along. How else to explain the fiascos in Syria and Benghazi, pulling out troops completely out of Iraq and Afghanistan, and radically downsizing the Navy. And one that no one even remembers: when the Iranian people tried to have their own version of the Arab Spring (I know Iranians are not Arab), Obama said nothing and did nothing while the mullahs' thugs murdered demonstrators in the streets and arrested and tortured them. Meanwhile, Obama helped overthrow one of our strongest, most loyal allies, President Mubarek in Egypt, who was replaced by a member of the Moslem Brotherhood.

And if it's treason or a violation of the secrecy laws for Snowden and that cross dressing pervert Bradley Manning (how the hell did he ever get in the Army?) to leak secrets to Julian Assange, how do Obama and Biden get away with blowing the Navy Seals' cover in the Bin Laden raid? That led directly to a platoon from Seal Team Six being set up and shot down in Afghanistan.

It is just as bad domestically. The Affordable Care Act a/k/a Obamacare is a socialist takeover of the health care innsurance industry. Of course the "conservative" chief justice John Roberts wrote the opinion that said it was constitutional. Obama's latest project is a homosexual employment rights act (see below). The Obama agenda is to weaken the U.S. internationally, and undermine our culture and society internally. The whole gay rights thing, especially when it involves the military, is designed to make this country an easier target.

I have made a solemn vow - I will never vote for a f-------- democrat again as long as I live.

Texas attorney guilty in cartel laundering case
EL PASO, Texas (AP) — A West Texas lawyer and former Carnegie Mellon University trustee was found guilty Monday of conspiring to launder hundreds of millions of dollars in drug money for a Mexican cartel.

Marco Antonio Delgado was accused of devising a scheme to launder up to $600 million for the now-disbanded Milenio cartel from 2007 to 2008.

Delgado faces up to 20 years in prison on the single count and is scheduled to be sentenced Jan. 24. Defense attorney Richard Esper said they plan to appeal.

When media consultant Brian Aitken moved from Colorado to New Jersey to be closer to his son in 2009, police found legally-purchased, locked, and unloaded handguns in the trunk of his car. Aitken was arrested, imprisoned, and denied the ability to see his son.
Although Aitken regained a small taste of freedom when his 7-year sentence was commuted after 4 months, he has yet to get his life back. He is labeled a felon, which means he cannot own guns, he cannot vote, and he cannot travel internationally since his passport was revoked. Moreover, because of the firearms charges he faced over his legally purchased guns, he is barred from seeing his son.

After blacking out at a party, a 14-year-old Missouri teenager, showing signs of sexual assault, was abandoned, alone and unconscious, on her family’s frost-covered lawn by a group of her male classmates.

“The low temperature in the area that day was listed at 22 degrees, and the teen had spent roughly three hours outside, wearing only a T-shirt and sweatpants. Her hair was frozen. Scattered across an adjacent lot were her daughter’s purse, shoes and cellphone,” writes Dugan Arnett in a harrowing report in the Kansas City Star on how the small town of Maryville, Mo., turned on the victim, Daisy Coleman (Daisy and her mother elected to be named in the story), after she reported the incident, in which she was allegedly raped by a male classmate while another filmed it.

Melinda Coleman discovered her daughter on the lawn and, after removing her frozen clothes, noticed abrasions on her daughter’s body consistent with sexual assault. She immediately called the police. And, in perhaps the only bright spot in this dark story, the police acted swiftly.

The rapist is the grandson of a powerful state senator. Not only was he not charged, the whole town turned on the girl and her family and ran them out of town and burned their house down.

David Berg's "Run, Brother, Run"'; Texas Judged De-Benched; W. Texas Lawyer on Trial for Money Laundering


David Berg may be the greatest trial lawyer the average "man on the street" has never heard of. He in in his early 70's now, still a practicing trial lawyer and a successful author. His firm is based in Houston, with offices in Washington DC and New York City. He argued and won a free speech case at the Supreme Court at the tender age of 27. The American Bar Association published his book "The Trial Lawyer: What It Takes to Win," which costs $75 and is worth every penny. I go back to it every time I am preparing for trial.

Berg has a new book, Run, Brother, Run published by Schribner, that is part memoir of growing up Jewish in the redneck South of the 1950's, a murder mystery, and a trial story. He worshipped his older brother, Alan, who was murdered in 1968, his body dumped in a drainage ditch in Fort Bend County. David and Alan's father was cheated out of thousands of dollars by people claiming to have information - Alan was alive in Mexico, or Chicago, or somewhere else. The father hired a big name private investigator and former HPD homicide cop named Claude Harrelson, who quickly came close to "solving" the case, reporting that Alan had been murdered over a gambling debt, and the general location of the body. Apparently he didn't think he got enough money, because he never found the body. In fact, he did know where it was, because his brother was Charles Harrelson, a notorious hitman, who later assassinated U.S. District Judge "Maximum John" Wood in San Antonio.

Six months after Alan went missing, an honest investigator found the body, and id'd the killer. Harrelson hired Percy Foreman, then the most successful and famous lawyer in the country. If any lawyer deserves to be in the Judges and Lawyers Hall of Shame, it's Foreman. I don't want to give too much away, but if you want to see the criminal "justice" system at its sleaziest, you have to read this book. In a tight case, he could always call on a stable of "reserve" witnesses who could give the defendant an alibi. Writing of his father, whose feud with a former employee in a carpet selling business may have been the real reason for Alan's murder, Berg says, "We often conspire with our memories to make things come out as we want, not as they did."

My only criticism of the book is that Mr. Berg almost idolizes Richard "Racehorse" Haynes, who wanted to assist the incompetent district attorney prosecute Harrelson. There are reasonable people who think Haynes will do whatever it takes. For example, read Gary Cartwright's "Blood Will Tell: the Murder Trials of T. Cullen Davis," where he describes how Haynes co-counsel Phil Burleson's "witness factory" "found" a surprise witness who saw a man - not Davis - dressed in black sneaking up to the mansion where a 12 year old girl was executed, her mother shot, a man killed and another paralyzed for life.

If you go to Texas Criminal Defense Lawyers Assoc. annual convention, lawyers like Foreman, Haynes, and Gerry Spence are worshipped like gods. I've heard Haynes do what is in effect a standup comedy routine a number of times, always the same stories, several about his great friend Percy Foreman. Like the one where Haynes represented Foreman in a personal injury case, and Foreman got caught lying that he had never had back pain until the wreck, and the defense lawyer pulled out a stack of medical records where Foreman had been hospitalized for back injuries. When Haynes told the jury that Foreman didn't remember because he was getting senile, Foreman jumped up and called him a son of a bitch. The crowd of adoring lawyers loved the story about the two colorful old trial lawyer legends.

Notwithstanding my minor criticism, Run, Brother, Run gets 5 out of five stars. It took courage to write it.

Texas judge forced to resign after caught texting instructions to assistant DA during trial
Elizabeth E. Coker may forever be known as the "texting judge," but her notoriety will soon be all that is left of her days on the bench of the 258th District Court of Polk, Trinity, and San Jacinto Counties. Coker signed an "AGREEMENT TO RESIGN FROM JUDICIAL OFFICE IN LIEU OF DISCIPLINARY ACTION" with the State Commission on Judicial Conduct…
The agreement comes in the wake of a recent investigation revealing Coker texted instructions from the bench to a Polk County Assistant District Attorney who was assisting in the prosecution of a case in Coker's court.

Houston couple suing Carnival over stranded ship were never on the ship
Last week, attorney John Bruster Loyd filed a lawsuit on behalf of his clients Luke Cash and Ami "Summer" Gallagher stating that that couple had been aboard Carnival Cruise Lines' ill-fated Triumph excursion in February.

An engine-room fire on the Triumph left 3,100 passengers stranded at sea for days with limited food and toilet service, quickly becoming a media and business problem for the cruise line.

Carnival weighed in on the suit that the Cash couple is bringing to their doorstep, with spokesperson de la Cruz saying in a statement that the cruise liner is baffled as to why they are even suing Carnival.

"That this lawsuit was filed, alleging the plaintiffs suffered injury and mental anguish during a cruise they weren’t even on, is truly shameful and reprehensible. Further, the fact that the suit also alleges misrepresentation and fraud is quite ironic."

Ex-Texas soldier sentenced in child abuse case
SAN ANTONIO (AP) — An ex-Texas soldier who blamed post-traumatic stress disorder for sexually assaulting a 3-year-old boy has been sentenced to 30 years in federal prison.

Former Army Sgt. Wade Allen Perkins acknowledged to authorities that he coerced his girlfriend, also a former soldier, into sex acts with the child.

The San Antonio Express-News reports (http://bit.ly/16ag6Lt ) that at a sentencing hearing Friday in San Antonio, Chief U.S. District Judge Fred Biery said he wished he could have given Perkins more time for the production of child pornography charge.


Testimony ends in Texas lawyer's laundering trial
EL PASO, Texas (AP) — Testimony ended Friday in the trial of a West Texas lawyer and former Carnegie Mellon University trustee accused of conspiring to launder drug money, and closing arguments are scheduled for Monday.

Marco Antonio Delgado is accused of devising a scheme to launder up to $600 million for a Mexican drug cartel in 2007 and 2008.

Delgado testified on Thursday and Friday, saying he never knew the funds he handled were illegal. Prosecutors argue he conspired with Lilian De La Concha, the ex-wife of former Mexican president Vicente Fox Quesada, and others to launder money for the now disbanded Milenio cartel.

3 jailers quit for smuggling drugs to inmates

Chance and several of his fellow thugs are black; the young family they attacked are Asian. Question: will Obama say anything about hate crimes in this case?
New York has the toughest gun laws in the country. It pretty much leaves law abiding citizens at the mercy of career criminals.

Motorcycle Thugs, Second Amendment



I watched one of the clips on Youtube of the motorcycle gang terrorizing a family in New York City. My reaction was visceral. I wanted to have a machine gun and kill them all. Imagine how that man and his wife and little girl felt. But if he had a pistol and shot them, Obama and Bloomberg would have tried to get him indicted. Now it is coming out that there were several cops who were part of the pack. Which leads to these links that show that not every policeman is a hero.


Conroe Police Officer Indicted for Shooting Unarmed Teen

Russell Rios was 19, attending college, and working at a bank. He was also accused of stealing two iPhone cases from a Conroe Walmart in the early evening on July 31.

Conroe Police Sgt. Jason Blackwelder wasn’t on duty. He was in plain clothes but carrying a gun. When Rios broke away from Walmart staff and ran into a wooded area beside the store, Blackwelder chased him.
here, Conroe police say the two got into a “violent struggle” in which Rios choked Blackwelder until he was afraid he would pass out.

“This young man, he’s five-foot-seven, 140 pounds,” says Cade Bernsen, a lawyer for the Rios family. “String bean. And this cop is about six-foot, 190, 200 pounds. [Conroe police] said, ‘Oh, you know, he was choking the officer and the officer had to fire in self-defense.’ I just don’t see any scenario where that happens.”

Especially, Bernsen says, since Rios was shot in the back of the head.

And while Obama and Bloomberg want to gut the Second Amendment, here's a story that shows why law abiding Americans should have the right to carry. At least the driver of the car took one of the thugs out with his car - broke both legs and maybe paralyzed him.

NEW YORK (AP) — An unauthorized motorcycle rally featuring hundreds of bikers parading through the streets took a bloody turn when a large group of riders surrounded a man driving with his family, then chased his SUV for miles after he plowed through a blockade of bikes and beat him.

One biker suffered broken legs and apparent spine injuries when the SUV ran over him and may be paralyzed, police said. A second biker suffered a leg injury. The driver, who was traveling with his wife and toddler, needed stitches to his face at a hospital.

The frightening assault on the man began Sunday afternoon on Manhattan's West Side Highway and was partially captured on a helmet-mounted video camera worn by one of the riders involved in the chase.

Several cops may have watched biker beatdown
An off-duty undercover NYPD cop was among the pack of bikers who chased a family up the West Side Highway — and he stood by as the dad was hauled from his car and beaten, sources told The Post.
The unidentified officer waited three days to come forward Wednesday night. He has been placed on modified duty and turned in his gun and badge on Friday, the sources said.
He rides with the New Rochelle-based Front Line Soldiers, a club that also counts several other cops among its members, a source said.

How Not to Dress for Court


I am constantly amazed at how some people dress when they go to court. Defendants charged with drug offenses show up in baggy teeshirts with pictures of Bob Marley smoking a joint. Some look like they got dressed to stand on a street corner selling cocaine, in football jerseys and baggy shorts and sporting gold chains and gang tattoos. One morning a young woman wore a tight pink teeshirt with sequins spelling “Spoiled Rich Girl.” An older woman wore a tube top that barely contained her surgically enhanced breasts.

When you’re charged with any crime, it’s not a good idea to go to court dressed like a street walker or pimp or drug dealer. The judge in your case has the power to send you to prison or give you probation, and impressions matter. You should dress like you are applying for a job that you really want - clean pressed shirt and slacks for men, shined shoes or boots, same for women or skirt or dress. Here, then, are a few rules for how to dress and act when you go to court.

No shorts
No tube or tank tops
No flipflops
No teeshirts
No hats in courtroom
Cover tattoos
No gum
No tobacco or snuff
No flashy jewelry
Cell phones off
No grills
No guns or knives

Grotesque Prosecutorial Misconduct by Federal Government in Danziger Bridge Case in New Orleans



Judge finds ‘grotesque’ prosecutorial misconduct in Danziger Bridge shootings case
Judge Kurt Engelhardt’s decision overturning the convictions of five New Orleans police officers for their roles in the Danziger Bridge shootings runs to 129 pages. Page by page, the decision addresses claims of prosecutorial misconduct, and it is as if, page by page, the judge’s anger and disbelief only grow.

He finds ample misconduct, and terms it “grotesque.” He uncovers other damning material, and professes “shock and dismay.” In the end, he closes with a distinct sense of foreboding: The worst may be yet to come.

“One can only wonder what other unanticipated revelations might be in store,” he writes.

Engelhardt’s central finding was that federal prosecutors, during the trial of the officers for the shooting of unarmed civilians days after Hurricane Katrina, had posted anonymous comments on the website of the local newspaper, the Times Picayune.

Here’s how Engelhardt characterized those comments: “inflammatory invectives,” “accusatory screeds,” “vitriolic condemnations,” all of them directed at “the defendants, their attorneys, their witnesses, their evidence.”

Williamson County District Judge Ken Anderson Resigning as Part of Deal with State Bar; Did Western District Prosecutors Cover Up Torture and Murder in the Juarez House of Death?



District Judge Ken Anderson Resigned From The Bench
Ken Anderson was the Williamson County district attorney who sent an innocent man - Michael Morton - to prison for 25 years for a murder he didn't commit. Anderson hid evidence that would have exonerated Morton. Anderson went on to become a district court judge where he continued doing God's work sending people to prison for long, long terms, probably whether they deserved it or not. The Wilco Watchdog reports that Anderson has resigned, probably as part of a deal with the State Bar. "The State Bar alleges Anderson committed professional misconduct in the 1987 murder trial against Michael Morton because he deliberately withheld two key pieces of evidence that likely would have led to a not-guilty verdict. He is being prosecuted under what’s known as the Brady law, which requires prosecutors to deliver all evidence favorable to the defense." He is surrendering his law license.
It is almost unheard of for the Bar to go after a judge or a prosecutor, who have almost total immunity for anything short of murder. The article reports that Anderson will serve 10 days in county jail - he ought to do at least 10 years in the Big House.

Litigation Claims US Officials Conspired To Silence The Informant And Cover-up Their Role In The House of Death Murders

A former US government informant who penetrated one of the most ruthless drug organizations in Mexico has filed a multi-million dollar lawsuit against a group of federal prosecutors and agents as well as several county sheriffs and detention-facility officials alleging they acted in a conspiracy to violate his civil rights.
The accuser, Guillermo Eduardo Ramirez Peyro, is a former Mexican federal cop who worked for a top lieutenant (Humberto Santillan Tabares) of the Vicente Carrillo Fuentes drug organization in Ciudad Juarez, Mexico, in the early to mid-2000s.
As part of that work, Ramirez Peyro was responsible for overseeing the infamous House of Death, which was the site of multiple gruesome torture/murders. A dozen bodies were ultimately found buried in the backyard of the house, located at 3633 Calle Parsonieros in Juarez. Ramirez Peyro was charged with assuring the house was opened up whenever Santillan wanted a murder carried out, and he also was responsible for overseeing the burial of the bodies at the house.
The lawsuit was filed in federal court in New York under seal in late July and seeks in excess of $125 million in damages from the defendants collectively.
Among those named in the lawsuit are former Western District of Texas US Attorney Johnny Sutton as well as Margaret Leachman, now Criminal Division chief in the Western District; Richard Durbin, now first Assistant US Attorney in the Western District; and Juanita Fielden, Assistant US Attorney in the Western District’s El Paso division.

Tom DeLay conviction overturned by Texas court

A Texas appellate court has overturned the conviction of former House Majority Leader Tom DeLay (R-Tex.) for allegedly scheming to influence Texas state elections with corporate money. A three-judge panel voted 2-1 to overturn the conviction, calling the evidence "legally insufficient," according to court papers released Thursday. The decision formally acquits DeLay of all charges, but it could still be appealed by the government. (Read the court's majority opinion and dissenting opinions.

I'm not a fan of Delay, but I thought from the get go that the prosecution was politically motivated.

Nazi Perverts
I'm listening to and reading William L. Shirer's The Rise and Fall of the Third Reich, which he wrote shortly after World War II. Shirer lived in Germany when Hitler was coming to power, and after the war had access to thousands of pages of contemporary documents. The book is well written, insightful and horrifying. He makes an interesting point that the Nazis, who thought of themselves as supermen, the best of the best, were a bunch of perverts. This book would never get published today, with its politically incorrect language:
"But the brown-shirted S.A. never became much more than a motley bunch of brawlers. Many of its top leaders, beginning with its chief, Roehm, were notorious homosexual perverts. Lieutenant Edmund Heines, who led the Munich S.A., was not only a homosexual but a convicted murderer. These two and dozens of others quarreled and feuded as only men of unnatural sexual inclinations, with their peculiar jealousies, can." p. 120.

"No other party in Germany came near to to attracting so many shady characters. As we have seen, a conglomeration of pimps, murderers, homosexuals, alcoholics and blackmailers flocked to the party as if to a natural haven. Hitler did not care, as long as they were useful to him." p. 121-22.

Hitler himself had virtually no relationships with girls or women, except for a bizarre, masochistic affair with his much younger niece, who shot herself to get away from him.

MDMI - Manifestly Dangerous Mentally Ill; Inmates Running the Asylum; Chapo Guzman in Chicago


This month's edition of the Texas Bar Journal has an excellent article by Judge Tom Rickhoff and Ellen Patterson titled "Dangerous Minds: addressing violence and serious mental illness from one judge's perspective," available here online. Bexar County Probate Court No. 2 Judge Tom Rickhoff suggests legislative reform to help identify those who are “manifestly dangerous mentally ill” (MDMI). The judge updated a paper written in 2006 with the rare focus on protect- ing the public, with current research by legal intern Ellen Patterson.
The timing of this article is eerie, coinciding with the mass murders in the Washington Naval Yard. The article closes with this prophetic statement: "Mental illness and violence will con- tinue its costly toll worldwide; however, embracing effective reforms will help eliminate the suffering and costs and address the needs of each individual."

33 arrested in months-long downtown Austin drug sting

Austin police have arrested 33 drug sellers and buyers in a narcotics sting targeting downtown. The sting ran from July 11 to Sept. 4 and resulted in the department issuing 40 warrants to 33 people, according to a news release from the Austin Police Department.
Among them, the 33 arrested have had 1,842 involvements with Austin police, according to the department. "These individuals regularly require police services, preventing officers from working on other community problems," the release said.

Bloomberg Business News has a good article about how Chapo Guzman's Sinaloa cartel has taken over drug trafficking in Chicago (Heroin Pushed on Chicago Fueling Gang Murders, by John Lippert).

A common thread in these articles is that thousands of people who cannot legally own a gun have them. The Navy Yard shooter even had a CHL license, notwithstanding the fact that he had been arrested for shooting out a neighbor's tires, and shot through the ceiling of his apartment into the one above him. Most of the Chicago gangsters have long rap sheets, but they have guns. Instead of taking away guns from law abiding ciizens, why don't the authorities round up the thugs with guns and lock them up for the max?

Was Nixon a Traitor?


The October issue of Vietnam, published by Weider History Group and available at books stores (including Hastings), makes a strong case that Nixon, in addition to being a thief, liar, and incipient fascist, was a traitor. The article is titled "The Unexploded Election-Eve Bombshell," written by Beverly Deepe Keever, and an excerpt from her new book Death Zones and Darling Spies: Seven Years of Vietnam War Reporting, published by the University of Nebraska Press.

It was 1968, and the U.S. had been fighting in Vietnam for going on five years. Lyndon Johnson's presidency was in ruins. LBJ wanted to end the war, and shocked the world when he announced in the same televised appearance that he was suspending bombing North Vietnam, and he would not run for re-election. Our diplomats began informal peace talks with the North Vietnamese.

Richard Nixon (who was a corporate lawyer) had a Chinese spy named Anna Chenault, a/k/a the Dragon Lady, tell South Vietnam's President Nguyen Thieu that if he held out until Nixon became president, he would get South Vietnam a much better deal. Thieu refused to talk to the North, and we had four more years of war, killing thousands of Vietnamese and Americas.

LBJ called Senator Everett Dixon, the highest ranking Republican in the Senate, and asked him to tell Nixon to stop. Their conversation was recorded, and they agreed that Nixon was committing treason. But Johnson decided not to go public because of the damage the revelation would do to the country. LBJ said "they're contacting a foreign power in the middle of a war," it was treason, and have blood on his hands. What is really sickening is that Nixon did it to make Johnson look bad.

Through a Glass Darkly - How the Media Sells the Public a Fantasy



The theme that runs through these pieces is that the media sells the public a distorted view of the world. Poor little Matthew Shepard was murdered by vicious, homophobic rednecks in Laramie, WY. On television, cops are always the good guys, and can take out a hit team armed with AK-47's and RPG's with only a .38 revolver, or maybe a Glock, which in t.v. land holds about 100 rounds. Homeland Security and TSA are there to protect us. And so on.

NO H8? -- BOMBSHELL BOOK: MATTHEW SHEPARD TORTURED, MURDERED BY GAY LOVER
Matthew Shepard was the winsome young homosexual in Laramie, Wyoming who in October 1998 was tortured, killed, and left hanging grotesquely from a fence. He was discovered almost a day later and later died in the hospital from his horrific wounds.... Almost immediately Shepard became a secular saint, and his killing became a kind of gay Passion Play where he suffered and died for the cause of homosexuality against the growing homophobia and hatred of gay America....
But what really happened to Matthew Shepard? Thanks to a new book by an award winning gay journalist we now know that much of this narrative turns out to be false, little more than gay hagiography.
As gay journalist Aaron Hicklin, writing in The Advocate asks, “How do people sold on one version of history react to being told that the facts are slippery --- that thinking of Shepard’s murder as a hate crime does not mean it was a hate crime? And how does it color our understanding of such a crime if the perpetrator and victim not only knew each other but also had sex together, bought drugs from one another, and partied together?”
This startling revelation comes in The Book of Matt to be published next week by investigative journalist Stephen Jiminez, who over the course of years interviewed over 100 people including Shepard’s friends, friends of the killers, and the killers themselves.
He was beaten, tortured, and killed by one or both of the men now serving life sentences. But it turns out, according to Jiminez, that Shepard was a meth dealer himself and he was friends and sex partners with the man who led in his killing. Indeed, his killer may have killed him because Shepard allegedly came into possession of a large amount of methamphetamine and refused to give it up.
The book also shows that Shepard’s killer was on a five-day meth binge at the time of the killing.

CHARLOTTE, N.C. An unarmed man who may have been looking for help after a vehicle wreck was shot and killed by a police officer Saturday as he ran toward him, police said. The officer was later charged with voluntary manslaughter.

TSA Agent Arrested for Smuggling Illegal Aliens
A Transportation Security Administration (TSA) agent was arrested Friday for conspiring to smuggle illegal aliens into the country.According to a Justice Department press release, a group of Brazilian nationals were smuggled through the Luis Muñoz Marín International Airport in San Juan, Puerto Rico.

Díaz-Torres allegedly allowed the Brazilians through a TSA security checkpoint without questioning them.

The group then flew to New York, Boston, and Philadelphia on commercial flights.


Ex-judge is headed for prison
BROWNSVILLE — A former state district judge was sentenced Wednesday to six years in prison for his role in a cash-for-favors scheme that implicated a dozen defendants and badly damaged the image of the justice system in South Texas.

U.S. District Judge Andrew Hanen sentenced Abel Limas on a single count of racketeering and ordered him to pay restitution of more than $6,777,000.
Faced with up to 20 years in prison, Limas said he “saw the writing on the wall” and provided the FBI with dozens of interviews and became a key witness for prosecutors in four separate trials against attorneys Marc Rosenthal, Ray Marchan, Eduardo Lucio III and former Cameron County District Attorney Armando Villalobos.

Mingo judge arrested on federal charge
Thornsbury tried to put romantic rival in jail, feds say
CHARLESTON, W.Va. -- Mingo County Circuit Judge Michael Thornsbury was arrested Thursday after federal authorities allege he targeted his ex-lover's husband and used his position on the bench to manipulate criminal charges against the man.

The indictment, returned Wednesday by a federal grand jury in Charleston, charges Thornsbury with conspiring to violate the constitutional rights of his former secretary's husband.

Two Florida cops shot an innocent, unarmed man in his own driveway. And then their sheriff started talking.

wo weeks ago, two Florida deputies shot 15 rounds at a 60-year-old unarmed Florida man who was looking for his cigarettes in his mother’s car, parked in his own driveway. Two of those bullets hit him in his left leg, which was shattered. Roy Howard Middleton says he was compliant when the cops told him to turn around. He says that as he was turning around to face deputies with his hands raised, they opened fire.
A week later six Escambia County deputies climbed through the window of a private residence, without a warrant, dragging a sleeping couple out of their bed, shooting at their two dogs, one of which later died. The police were pursuing a suspect in an armed disturbance earlier in the evening on the couple's street, found an upside-down bucket next to a window of their home, knocked on the door, and when nobody answered, they just entered through the window.
